California Privacy Policy

This California Privacy Notice (this “Notice”) supplements the Privacy Policy and applies solely to California residents.

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act and its implementing regulations (collectively, the “CCPA”) provides California residents with certain rights in relation to their personal information (as defined in and subject to the CCPA). Pursuant to the CCPA, this Notice provides additional details regarding our collection, use, and disclosure of California residents’ personal information that is subject to the CCPA. This Notice also describes the rights available to you as a California resident in relation to certain personal information we maintain and how you can exercise those rights.

Capitalized terms used but not defined in this Notice have the definitions ascribed to them in the Privacy Policy.

NOTE: Debt.Help is not a financial institution subject to the Gramm-Leach-Bliley Act (“GLBA”). The CCPA and this Notice do not apply to personal information we collect, maintain, use, or disclose to the extent such information is governed by or subject to the GLBA and related regulations. For example, personal information relating to consumers who use the Services to initiate or complete the process of requesting or applying for financial products or services, including loan requests or inquiries, is subject to the GLBA or the California Financial Information Privacy Act, as applicable, and exempt from the CCPA. This means the CCPA does not require Debt.Help to honor access, deletion, correction, or opt-out requests relating to personal information that is subject to the GLBA and as a result exempt from the CCPA. The CCPA and this Notice apply only to California residents whose interactions with us are limited to:

  • Visiting the Digital Properties;
    • Signing up for our email alerts;
    • Commenting on or contributing to our blogs; and/or
    • Establishing an account that does not include a financial product or service subject to the GLBA.

As noted in the table above, we “sell” or “share” (as these terms are defined in the CCPA) certain categories of personal information, and you may exercise your right to opt out of such disclosures by clicking the “Your Privacy Choices” link in the footer of our website (www.debt.help) and following the instructions.

We retain each category of personal information we collect for at least as long as necessary to fulfill the purposes described in the Privacy Policy, including to satisfy legal or reporting requirements.

PURPOSES FOR COLLECTING PERSONAL INFORMATION

As described in more detail in the “How We Use Personal Information” section of the Privacy Policy, we collect personal information to provide and manage the Services and achieve a variety of legitimate business or commercial purposes.

DISCLOSURES OF PERSONAL INFORMATION

As detailed in the “How We Disclose Personal Information” section of the Privacy Policy, we disclose personal information to fulfill specific processing purposes. We may also disclose certain categories of personal information to competent governmental and public authorities and other third parties as necessary or appropriate, including when we have a legal or contractual obligation to disclose the information.

SALE AND SHARING OF PERSONAL INFORMATION

We “sell” and “share” (as such terms are defined in the CCPA) certain categories of personal information to and with third parties. Additionally, as detailed in the chart above, we have “sold” and “shared” certain categories of personal information in the past twelve (12) months for analytics and advertising purposes. Refer to the chart above for additional details.

We do not “sell” or “share” the personal information of minors we know to be under the age of 16.

USE AND DISCLOSURE OF SENSITIVE PERSONAL INFORMATION

As detailed in the chart above, we collect certain “sensitive personal information” (as defined in the CCPA). However, we do not use or disclose sensitive personal information for any purpose outside of the limited permissible purposes set forth in the regulations implementing the CCPA. These purposes include providing the Services and preventing, detecting, and investigating security incidents.

YOUR LEGAL RIGHTS

As to personal information we collect that is subject to the CCPA, you have the right to request that we:

  • Disclose to you the following information covering the twelve (12) months preceding your request:
        o the categories of personal information we have collected about you and the categories of sources from which we collected such information;
        o the specific pieces of personal information we have collected about you;
          o the business or commercial purposes for collecting, selling, or sharing your personal information;
          o the categories of third parties to whom we disclosed such personal information; and
          o If we sold, shared, or disclosed your personal information for a business purpose, two separate lists disclosing:
                        ▪  sales and shares, identifying the personal information categories that each category of recipient received; and
                        ▪  disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
    • Delete personal information that we have collected from you, subject to certain exceptions.
    • Correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing.

We will not discriminate or retaliate against you if you decide to exercise your rights under the CCPA.

To protect consumer privacy, we will require the matching of up to three pieces of personal information provided with your request with information we maintain to verify that it is you making the request. Where applicable, we will use the requested information for verification purposes only. Please note that we may decline a request where we are unable to verify your identity and confirm the personal information we maintain relates to you. Additionally, we reserve the right to honor requests to access, correct, or delete personal information only to the extent required by applicable law.

AUTHORIZED AGENTS

You may authorize someone to submit a privacy rights request on your behalf (an “authorized agent”). An authorized agent will need to demonstrate that you have authorized them to act on your behalf, unless you have provided the agent with power of attorney pursuant to applicable probate law. Depending on the evidence provided, we may contact you to verify your identity with us or request confirmation from you that the agent is authorized to submit the request on your behalf.

EXERCISING YOUR SALE AND SHARING OPT-OUT RIGHTS

As detailed in the chart above, we “sell” and “share” certain categories of personal information to and with third parties. If you are 16 years of age or older, in addition to the rights described above, you have the right to direct us to not “sell” or “share” your personal information at any time. To exercise your opt-out right, you may submit a request to us by clicking the “Your Privacy Choices” link in the footer of our website (www.debt.help) and following the instructions.

CHANGES TO THIS NOTICE

We may update this Notice from time to time to reflect changes in our information-handling and privacy practices and/or changes in applicable law. The “Last Updated” date at the top of this page indicates when this Notice was last revised. If we make changes, we will revise the date at the top of this page. We encourage you to review this Notice periodically to remain informed about our information handling and privacy practices. By visiting or using our Digital Properties, you agree that any changes to this Notice shall apply to any personal information we may maintain about you, whether collected before or after such changes.
